Common Pleas April Term 1835


The State of Ohio Coshocton County in Court of Common Pleas, April Term A.D. 1835.


Anny McFarlane Will Probate, Letters Testamentary, Executrix of the last etc. will & Testament of Robert McFarlane, Deceased.


Be it remembered that now at April Term of said Court of Common Pleas, to wit, on the thirteenth day of April in the year of our Lord one thousand eight hundred and thirty three, the last will and testament of Robert McFarlane, late of said county, deceased, was produced to the Court, which reads in the words following, to wit--In the name of God, Amen. I, Robt. McFarlane of Coshocton county, State of Ohio, being weak in body but of sound mind, memory and understanding, thanks be to almighty God for the same, I, the above named Robt. McFarlane of Coshocton county, State of Ohio, do make and publish this my last will and testament in manner and form following, that is to say, First, it is my will that my funeral expenses and all my just debts be fully paid. Second, I give, devise and bequeath to my beloved wife Anny McFarlane, in lieu of her dower, the plantation on which we now reside, situated on Evans C. in Coshocton county Ohio, containing about one hundred sixty acres, during her natural life, and all the livestock, horses, cattle, sheep, hogs and etc, by me owned and kept thereon. Also all the household furniture and other items not particular named and otherwise disposed of in this my last will, during her natural life as aforesaid and as long as she remains my widow. She however first disposing of a sufficiency thereof to pay my just debts as aforesaid or so much thereof as may remain undispensed. Third, I give and devise to my oldest son Robert McFarlane one dollar. Fourth, to my daughter Mary Norris the sum of Ten dollars. Fifth, to my daughter Anny Paine the sum of Ten dollars. Sixth, to my daughter Rebecca McFarlane the sum of Ten dollars with a cow of value of Ten dollars & bed & bedding to the value of 15$. Seventh, to my daughters Barbara [?] [Sarah?], Jane, Margarett, Catherine and Susannah, I give, devise & bequeath the sum of Ten dollars to each and every one of the above named my daughters, and further my will is that at the end of one year after the day of their marriage of each or either of the above named my daughters, they shall be provided with a cow to the value of Ten dollars & a bed & bedding to the amount of fifteen dollars and further that if any of the aforesaid of my daughters remain single till after the demise of their parents, they shall still be entitled to the above named legacies--to be paid out of the personally property. And lastly I give and bequeath to my two sons Ezekial & Andrew and their heirs forever at the decease of my wife the plantation above described. To Ezekial I give and bequeath the South half of the above named plantation with all the improvements thereon, first by paying to or cause to be paid at the end of one year after the decease of their parents the sum of forty dollars to his brother Andrew McFarlane.
Furthermore, what personal property shall remain at the decease of my wife Anny McFarlane, after paying her funeral expenses, to be sold at public auction and equally divided between the above named my daughters, giving a reasonable credit on the things sold--and should there not be enough of personal property on the premises at the decease of the widow, the legacies is to be paid out of the real estate. In testimony whereof I have hereunto set my hand Seal this twenty sixth day of January, one thousand eight hundred and thirty three.
