The Last Will and Testament of John M. Duff
I, John, Duff, residing at this time at Coshocton do make and publish this my last will and testament.
Item 1st
It is my will that after my decease all my just debts be first fully paid.
Item 2nd
I will to my wife Mary E. Duff after my debts are paid, one third of my chattel property. If my wife should remain with my family until my youngest child arrives at age, it is my will that she also receive one third of my real estate. It is my will that my household goods be not sold so long as m wife and family remain together and to keep and use the same for the benefit of the family.
Item 3rd
I will and direct that my executor hencing after names as soon as the same can be realized out of my chattel property pay to my wife and family the sum of four hundred dollars for their maintenance, I direct that my executor sell the remainder of my chattel property excepting two horses, buggy and harness at the livery stable of Darling and Duff to be used by my family if the so desire if not the to be sold also.
Item 4th
It is my will that after the payment of my just debts the legacy to my wife and the four hundred dollars herein before mentioned, that my executors take charge of the residue of my estate as testamentary trustees to use the same for the benefit of my wife and minor children; it is m desire that said trustees invest said residue of my estate in a suitable home for ms wife and minor children, but if said trustees in their discretion should think that said residue of m y estate is not sufficient to buy a home suitable for my wife and minor children, then said trustees are use their discretion in using same residue for the support and maintenance of my said wife and minor children. If my wife does not remain with and care for my said minor children it is my will that she receive no share or benefit of said residue of my estate herein before mentioned. In the event she does not remain with the minor children and said minor children to receive for their support all that may be necessary of my property in the hand of my said trustees.
Item 5th
On the arrival at age of my youngest child it is my will that whatever may sill remain of m estate be divided among my children as follows. It is my will that Frank R. Duff and Riley M. Duff get no part of my estate. But Lewis Duff is to have to share and Annie Duff one and one half shares, and the balance to be divided share and share alike among the rest of my children.
Item 6th
I name and nominate as executors of this my will Hugh Addy and George C. Duff of Guernsey County, Ohio. After my executors have settled up my estate as executors, I desire them to act as testamentary trustees to my family and to manage the property for the family until such time as my property divided between my said heirs or legal representativer.
In witness here of I hereto set my and and seal this 25th day of February A.D. 1889.
