The Last Will and Testament of William Pancake Senior

 

From: The Knox County Will Book, Ohio common Please Court, Mount

Vernon, Ohio 43050

In the name of the benevolent father of all, I William Pancake, Sen, of Coshocton county, Ohio, do make and publish this my last will and testament.

Item 1st

I give and devise to my beloved wife, in lier of her dower the homestead where we now reside, situate in the town of Warsaw, including Lots No 41, 42, 43, with all the improvements and appurtenances thereto belonging together with a lot of land lying south of the Walhonding Canal near joining the Town plat of Warsaw, containing eight acres to wit: the same to her use and benefit during her natural life; also all the other provisions and hosuehold good and furniture in our possession oat the time of my decease. I also devise and bequeath to my said wife one horse and Buggy and one cow, and the one third of all the residue of my property, real and personal and not provided for above, or the proceeds thereof when sold as hereinafter mentioned.

Item 2nd

At the death of my said wife, I devise that the real estate set apart for her use above, and all personal property, and household goods as may be then on hand to be sold by my executor and the proceeds thereof to be dived by him into three equal shares, and pay one share to my son Samuel C. Pancake, and one share to be divided equal between by two grand daughters Mary J. Thompson and Rachel Ann Yonker, and one share to be divided equal between my three grand daughters, that is Rose Pancake, Mary L. Pancake and Cora W. Pancake, being the heirs of my son William C. Pancake, deceased.

Item 3rd

I bequeath to my grand daughter Rachel Ann Yonker, four hundred dollars, to be paid by my Executor out of the first money made on sale of property, or that may be collected by my Executor.

Item 4th

I do hereby nominate and appoint my son Samuel C. Pancake Executor of this my last will and testament, hereby authorizing and (empowering) him to (compromise), adjust, release and discharge in such manner as he may deem proper the debts and claims due me. I do also authorize and (empower) him to proceed immediately after my decease or at his earliest convenience without sacrafice to sell all my property both real and personal, to the best advantage, either by private or public sale, as he may think proper and best, provided my said wife be dead, but if should survive me, then all of my said property &c, except such as is included in the first item as is set apart for her during her hatural life, the sale and distribution of which is provided for at her death in item 2nd and also deeds to purchasers to execute, acknowledge and deliver in fee simple And so soon as my property is or can be sold and converted into money, I desire my Esecutor to pay out of the first money collected of my estate to Rachel Ann Yonker the sum of four hundred dollars as before mentioned, as a remuneration to her to balance One thousand dollars already paid by me to Samuel C. Pancake, and one thousand dollars already paid by me to William C. Pancake, now deceased. And one third of all the balance to be paid to my said wife if living, and the third to be equally divided into three shares, after paying my funeral expenses and all my just debts, allowing one share to my son Samuel C. Pancake, and one share to be divided qual by my Executor to my two grand daughters Mary J. Thompson and Rachel Ann Yonker, and one share to be divided by my Executor into three equal parts and pay one to my three grand daughters Rose Pancake, Mary L. Pancake and Cora W. Pancake, or their legal guardians if they are not of proper age, And if my said wife should not be living at the time of my decease then the proceeds of all property so sold to be divided and distributed as above set forth.

I desire that no appraisement or inventory be made of my property and that the Court of Probate direct the omission of the same in persuance of the statute.

I do hereby revoke all former wills by me made in testimony hereof I have hereunto set my hand and seal this 22nd day of April A.D. 1867.
