The Will

In the name of the benevolent Father of all, I Elizabeth Wood of the county of Coshocton and State of Ohio, do make and publish this my last will and testament.

Item 1st
It is my will that all my just debts and funeral expenses be first paid out of my estate, and that a tomb stone or monument similar to that standing over the grave of my son John, be erected over my last resting place, and that the cost of erecting the same be next paid out of my estate.

Item 2nd
It is my will that the balance of the money yet on hand, belonging to the estate of my late husband Joseph N. Wood, at the time of my decease, should be held by my son Harrison H [?] Wood, and that he apply said balance to the payment of the Beall children as directed by my late husband's will. The amount of said money can be ascertained by consulting the last account filed in the Probate Court of Coshocton County, by myself and my son Harrison as administrator and administratrix of my late husband's estate, and deducting therefrom the four hundred (400) dollars I have since paid to Joseph N. Beall, and any further sums I may [yet live?] to pay said children of Mary Beall, the balance of said money yet on hand, at this date is less than six hundred (600) dollars.

Item 3rd revoked [by codicil]

Item 4th
I give and bequeath to my daughter Emily H Cronell [?] all the silver spoons I have and own and my best looking glass, and one of my best bedsteads, and to my daughter Angeline Thomas, one of my best featherbeds and one bedstead.

Item 5th
It is my will that the balance of my household goods and furniture shall be equally divided among my four daughters, Mary Beall, Sarah Norman, Angeline Thomas, and Emily H. Cronell [?], and in case they do not wish to so divide said goods and furniture, these same shall be sold for money by my Executor, and the proceeds disposed of with the balance of my estate as hereinafter directed.

Item 6th
I give and bequeath to my son Harrison H. [?] Wood, my best family bible.

Item 7th
I give and bequeath to my daughter Sarah A Norman the sum of Eight Hundred (800) dollars in United States bonds, and to my daughter Angeline Thomas, I give and bequeath the sum on One Thousand (1000) dollars in United States bonds, and I give and bequeath to my daughter Emily H Cronell [?] the sum of One Thousand (1000) dollars in United States bonds; and if at my decease I do not own the amount of United States bonds above given to my said three daughters named in this item then it is my will, and I direct my Executor to divide whatever amount of said bonds I may own pro rata among my said three daughters, viz. Sarah, Angelina, and Emily H. and I direct my said Executor to pay to the said Sarah, Angeline, and Emily H in money, each, a sum equal in value and amount, which when added to each ones share of the said bonds so divided among them, as will give the said Sarah Norman the sum of eight hundred (800) dollars, and to the said Angeline Thomas the above said sum of one thousand (1000) dollars, the above sums to be paid within one year after my death.

Item 8th
It is my will, and I direct that the balance of my estate (not herein before disposed of) be equally divided among my four daughters, Mary Beall, Sarah Norma, Angeline Thomas, and Emily H. Cronell [?], and I direct that any sums going [one word] out of this item that falls to said Mary Beall shall be paid over to the trustee named in item three, by my Executor, to be paid and managed by said trustee in the same manner, and for the same uses and persons ([e.g.?] Mary Beall and her heirs) as designated and directed in item three of this my last will and testament. The sums [?] named in this item shall be paid within eighteen months after my death, if the same can be done within that time by my executor, or he thinks it for the best interest of my estate.

Item 9th
I will and direct that should any of my children, or their wives or their husbands, or any of their children or any of theirs, go into any litigation, or cause any litigation to be gone into concerning either my estate, or the estate of my late husband Joseph N. Wood, then and in that event all the moneys or other property coming to such person, or persons or their family or families, or any member of their family from my estate, as herein provided, shall not go to them, or to the members of their family as provided herein, but said bequest or bequests of money or property so given herein, shall go to and be equally divided among such of my said daughters as do not take any part in causing said litigation and where husbands or child or children have not caused such litigation, or gone into any such litigation as Plaintiffs: For I desire that my estate, and the estate of my late husband shall be settled if possible without any trouble or litigation among my children and hence it is my will that if any of my children or any member of their respective families go to law over the settlement of my estate or of my husband's estate that they or any of them so going to law shall forfeit all share of my estate as provided herein and said share shall go to and be equally divided among my daughters, as provided in this item who have not brought about or caused such litigation, and where husbands or children have not caused such litigation.

I do hereby nominate and appoint William S. Cronell [?] Executor of this my last will and testament.

I do hereby revoke all previous wills by me made. In testimony whereof I have herunto set may hand and seal this seventeenth (17) day of October in the Year of Our Lord One Thousand Eight hundred and seventy six (1876).

The First Codicil
Whereas I Elizabeth Wood on the 17th day of October AD 1876 made my last will and testament of that date, Therefore I do hereby declare the following to be a codicil to the same to wit:  I do hereby cancel and revoke the provisions of item Third (3) of my said last will and testament, making provision for my daughter Mary Beall and her children, and in lieu and place thereof, I do hereby give the sum of sixteen hundred dollars to my daughter Mary Beall in [this?] way.  I have invested said sum in a hous [sic] for her being Lots No. 131 & 131 [sic], & the  buildings thereon in Ricketts addition to the town of Coshocton, and said house is to be my said daughters during her natural life, and afterwards to her children in fee, and I have cause the deed so to be made to her and her children, hence no part of said sum of $1600.00 is to again be paid to her, and I further bequeath to my daughter Mary Beall the sum of five hundred (500) dollars in money, to be paid to her by my executor in eighteen months after my decease. The balance of mye state is to be divided and disposed of according to the other provisions of my said last will and testament or as I may hereafter direct.  In witness whereof I have hereunto set my hand and seal this 2nd day of June in the year of our Lord 1880. eighteen hundred and eighty

The second Codicil to said Will

Whereas I Elizabeth Wood on the 17th day of October A. D. 1876 made and published my last will and testament of that date and whereas on the 2nd day of June A. D. 1880, I made an published a codicil thereto. Therefore I do hereby declare the following to be a codicil to the same. I do hereby give to my daughter Mary Beall during her natural life the interest upon the further sum of one thousand (1,000) dollars which interest shall be paid to her by my Executor and for this purpose. I set aside the sum of one thousand dollars to remain in the hands of my executor and in case said Mary Beall should by reason of misfortune or illness require for her comfort more than the interest, then my executor is authorized to pay out for her benefit so much of said thousand dollars as in the judgment of my executor, my said daughter may require and my Executor is to receive such compensation for his services in the performance of this duty as may be reasonable, to be paid out of said fund and any balance of said fund that may be on hand at the death of said Mary Beall, shall be equally divided among her children then living but my Executor be the judge as to how much of said fund that is of the principal thereof) shall be paid out to the said Mary Beall for the purpose aforesaid during her life time.

In testimony hereof I the said Elizabeth Wood have hereunto set my hand and seal this 14th day of June in the year of our Lord one thousand eight hundred and eighty (1880).
